Research o n Anti-Monopoly a nd Protection of Consumer’s Rights

Safeguarding the interests of consumers is one of the legislative purposes of the Anti-Monopoly Law. However, since the law came into effect on August 1, 2008, there are still few examples of consumers successfully defending their rights after being harmed by monopolistic behavior. This article sorts out the laws, regulations and judicial interpretations that claim compensation after consumers have been harmed by monopolistic behaviors, as well as related cases, points out the main difficulties for consumers to protect their rights, and makes suggestions for amending the relevant provisions of the Anti-Monopoly Law and how consumer associations can assist consumers in protecting their rights.
